Rental conditions

 

1. Identity of the landlord

The accommodation is offered by the owner/landlord (hereinafter: “landlord”). Further details are provided with the booking confirmation.

2. Applicability

These general terms and conditions apply to all offers, reservations, and agreements relating to the accommodation.

By making a reservation, the renter (hereinafter: “renter”) agrees to these terms and conditions.

3. Nature of the agreement

  • The agreement concerns short-term tourist rental
  • The tenant obtains no tenancy rights or tenant protection
  • The accommodation may be used exclusively for recreational purposes.

4. Reservation and payment

  • A reservation is confirmed upon receipt of the (down) payment.
  • The landlord may refuse or cancel a reservation in the event of:
    • incorrect or incomplete data
    • manifestly unreasonable use
    • fraud or abuse

In such cases, access to the accommodation may be refused without refund.

 

5. Main tenant, guests and maximum occupancy

  • The main tenant is at least 23 years
  • The main tenant is responsible for all co-guests.
  • Only guests who have signed up and registered in advance are allowed to stay at the accommodation.
  • All guests, regardless of age, must be registered in accordance with SES Hospedajes. Identification is mandatory for guests aged 14 and older.
  • Maximum number of permitted guests:
    • 4 people aged 3 and older
    • 1 child up to and including 2 years (cot)

In case of exceeding:

  • access may be denied
  • can be terminated without refund
  • Pets are not allowed unless agreed in writing.

 

6. Included amenities

Included in the rental price:

  • bed linen and towels
  • beach towels (seasonal)
  • Wi-Fi
  • water and electricity
  • use of existing inventory
  •  

7. Usage & behavior

  1. Not permitted: smoking in the home, parties or events, nuisance (noise, behavior), use for illegal activities.
  2. The tenant shall use the accommodation as a careful user (“good housekeeper”) and in accordance with its intended purpose.
  3. The tenant is jointly and severally liable for compliance with these terms and conditions and the house rules by all co-guests and third parties who are in or around the accommodation with the tenant's permission.
  4. The tenant and all fellow guests commit to respecting local residents and neighbors. Causing a nuisance, including but not limited to noise nuisance, public drunkenness, aggressive behavior, and illegal activities, is not permitted.
  5. The landlord has the right to terminate the stay immediately in the event of nuisance, misconduct, or violation of these conditions. In that case, there is no right to a refund of the rental amount.
  6. The landlord or their representative has the right to enter the accommodation if this is reasonably necessary for maintenance, inspection, or in emergencies. To the extent possible, this will be announced in advance.
  7. Smoking is not permitted in the accommodation. In the event of a violation, additional cleaning and repair costs may be charged.
  8. The accommodation is delivered clean and must be left in reasonable condition upon departure. Additional charges will apply in case of extreme soiling or abnormal use.

 

8. Liability & Insurance

  1. The tenant is fully and jointly liable for all damage to the accommodation, inventory, and common areas, as well as for loss of belongings, caused during the stay by the tenant or fellow guests.
  2. Damage serves to be reported immediately to the landlord.
  3. Any damage or missing inventory will be determined upon inspection after the tenant's departure.
  4. The landlord is entitled to charge the tenant for damages and incidental costs retrospectively. Payment must be made within a reasonable period after invoicing.
  5. The tenant is strongly advised to have a valid international liability insurance and travel insurance to be taken out with coverage for damage to rented accommodations.
  6. The tenant remains liable for damage at all times, regardless of whether and to what extent insurance provides coverage.
  7. The absence of insurance does not affect the tenant's liability.

 

9. Cancellation conditions

In case of cancellation by the renter:

  • More than 60 days before arrival The entire deposit will be refunded, less cancellation fees of 5% or €50.00 (whichever is higher), if the landlord succeeds in finding another tenant.
  • Between 30 and 60 days: The entire deposit will be refunded, less 10% cancellation fees or €100.00 (whichever is higher), if the landlord succeeds in finding another tenant.
  • Less than 30 days before arrival: the right to a refund of the full rental amount lapses.
  • Partial cancellation or early departure does not entitle you to a refund of the rent.
  • No compensation will be paid in the event of 'force majeure' (something that cannot be foreseen or is beyond the landlord's control).
  • It is advised to take out travel and cancellation insurance.

 

10. Landlord's liability

The landlord is not liable for damage, loss, theft, injury, or inconvenience during the stay, unless caused by intent or willful recklessness (gross negligence).

This includes, among other things:

  • accidents in and around the home
  • loss of personal property
  • temporary outage of internet, water, or electricity

 

11. Parking (only applicable to Apartment Alderete)

  • A maximum of 1 vehicle may be parked in the designated spot in the garage under the apartment.
  • use at your own risk
  • The landlord is not liable for damage or theft

 

12. Applicable law and disputes

  • The agreement is Spanish law applicable
  • Disputes shall be submitted to the competent court in Spain.
  • The parties first seek an amicable solution.

 

13. Language and interpretation

These terms and conditions have been drawn up in Dutch. In the event of translation into other languages, the Dutch text shall prevail, unless mandatory law provides otherwise.

Personal data that we process

La Tierra Sur processes your personal data because you use our services and/or because you provide this data to us yourself.

  • Other personal data that you actively provide, for example by creating a profile on this website, in correspondence and by telephone

  • Handling your payment
  • Sending our newsletter and/or advertising brochure
  • To be able to call or email you if this is necessary to provide our services
  • To deliver goods and services to you
  • La Tierra Sur also processes personal data if we are legally obliged to do so, such as data that we need for our tax return.

How long we keep personal data

La Tierra Sur does not store your personal data for longer than is strictly necessary to achieve the purposes for which your data is collected. We use the following retention periods for the following (categories) of personal data:

Sharing personal data with third parties

La Tierra Sur shares your personal data with third parties if this is necessary for the execution of the agreement and to comply with any legal obligation. We enter into a processing agreement with companies that process your data on our behalf to ensure the same level of security and confidentiality of your data. La Tierra Sur remains responsible for these processing operations. In addition, La Tierra Sur provides your personal data to other third parties. We only do this with your express permission. It is therefore necessary to register all persons staying with the Spanish government. To do this, we follow the required steps that entail registration for your stay. A valid proof of identity is required.

Cookies, or similar techniques, that we use

La Tierra Sur only uses technical and functional cookies. And analytical cookies that do not infringe your privacy. A cookie is a small text file that is stored on your computer, tablet or smartphone when you first visit this website. View, adjust or delete data

You have the right to view, correct or delete your personal data. You can do this yourself via the personal settings of your account. In addition, you have the right to withdraw your consent to data processing or to object to the processing of your personal data by our company and you have the right to data portability. This means that you can submit a request to us to send the personal data we have about you in a computer file to you or another organization mentioned by you.

To ensure that the request for access has been made by you, we ask you to enclose a copy of your proof of identity with the request. Make your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and Citizen Service Number (BSN) black in this copy. This is to protect your privacy. La Tierra Sur will respond to your request as quickly as possible, but in any case within four weeks.
